E, ovviamente, il carcere preventivo non è una condanna, ma è uno strumento (spesso abusato) che si usa nella fase delle indagini, prima ancora di giungere a processo. Tutto vero, però un’idea, evidentemente, Salvini se l’è fatta. E pare non coincidere con le conclusioni della Commissione. Può succedere, ma Di Martino non l’ha presa benissimo e, c’è da immaginarselo, nemmeno Salvini. Ce ne faremo una ragione.
Punto due: c’è un altro passaggio che fa riflettere e che deve per forza di cose riaprire la discussione sui “tempi” della giustizia sportiva (e, se vogliamo, di quella penale, come ricorda Palombo, sempre sulla Gazzetta). «In questi mesi abbiamo acquisito altri elementi che hanno aggravato la sua posizione, ma per ovvi motivi non ho potuto fornirli a Palazzi».
Ovvero, e si riferisce a Mauri, ci sarebbero elementi nuovi emersi che peggiorerebbero ulteriormente la sua posizione rispetto alle carte in possesso dalla giustizia sportiva. Elementi che Di Martino dice di possedere ma di non aver trasmesso (intendiamoci: è sua legittima facoltà) a Palazzi. Il motivo? Presto detto: l’intero processo sportivo si è basato e a questo punto si baserà solo e soltanto, come accaduto in verità a tutti gli altri, su un’indagine penale ancora in corso (apro parentesi: è esattamente quando accaduto per Calciopoli, semmai ci torniamo dopo). Questo vuol dire che c’è ancora spazio per nuove indagini, nuove scoperte, nuovi retroscena. E che, non essendo ancora finiti a processo, manca anche completamente una controindagine difensiva che magari smonti alcune delle teorie accusatorie, direbbero i difensori del laziale.
Vere entrambe le cose. Resta il fatto che fornire giudizi oggi, con carte incomplete e possibili fatti importanti ancora ignoti (a Palazzi), porta inevitabilmente al pericolo concreto di sentenziare su un qualcosa di ancora non definito, su un teorema non ancora completato, su un puzzle cui l’accusa sta ancora cercando di far combaciare tutti i tasselli e che la difesa deve ancora iniziare a smontare. Insomma fra qualche mese può uscire fuori la “prova” (semplicizzo, ma è per capirci) che magari, mi auguro di no per il ragazzo, porterà ad una condanna penale nei suoi confronti. Mentre, la giustizia sportiva, non avendola mai avuta a disposizione, lo assolverà. Un pasticcio.
L’esempio più lampante, direi scolastico, di un pericolo simile (e di un pasticcio, grosso, realizzato davvero) ce l’abbiamo avuto con Calciopoli: se il procedimento sportivo, invece che nel 2006 si fosse svolto qualche anno dopo, quando il processo penale è entrato nel vivo e sono emerse un sacco di novità rispetto alle carte di allora, probabilmente i risultati sarebbero stati differenti.
